Workers with disability

 

The status of “Worker with disability”

 

What is this?

A person affected by a disability may apply for the status of worker with disability. A person with this status receives job offers adapted to his or her disability from the Employment Administration (ADEM). If he or she does not find a job due to the disability, he or she may receive the “the allowance for persons with severe disabilities”.

 

Conditions to be fulfilled

Option 1:

  • you work for a company legally established in Luxembourg;
  • your capacity to work is reduced by at least 30% (due to a work-related accident at a company legally established in Luxembourg, a physical, mental, sensory or psychical deficiency and/or psychosocial difficulties aggravating the deficiency or following events of war);
  • your medical condition is stable (not prolonged illness and no ongoing invalidity procedure);
  • you have a residence permit (if you do not have a residence permit, consult the section “Settling in Luxembourg").

Option 2:

  • you are registered as a jobseeker with the Employment Administration (ADEM);
  • your capacity to work is reduced by at least 30% (due to a work-related accident at a company legally established in Luxembourg, a physical, mental, sensory or psychical deficiency and/or psychosocial difficulties aggravating the deficiency or following events of war);
  • you are recognised as capable of exercising paid employment on the ordinary labour market or in a protected workplace;
  • your medical condition is stable;
  • you have a residence permit (if you do not have a residence permit, consult the section “Settling in Luxembourg").

 

Steps to be taken

  • ask for an application form from the Medical Committee of the Employment Administration (ADEM);
  • fill in the form and send it back to the ADEM Medical Committee;


The following documents must be enclosed with the application:

  • a birth certificate;
  • a recent medical report from your general practitioner;
  • a detailed medical assessment by the employment doctor of the Employment Administration indicating the causes and the degree of incapacity to work;
  • a residence certificate;
  • a certificate of subscription to Social Security drawn up by the Joint Centre for Social Security;
  • documents attesting your professional situation (for example: employment contract, certificate of registration with ADEM, etc.);
  • a copy of your residence permit;
  • if the applicant requires representation in such a procedure: documents certifying the capacity of the legal representative.

 

Decision - waiting times – appeals

The Medical Committee sets the percentage of reduced working capacity assessed in relation to that of an able-bodied person of the same age. If you are recognised as having the status of worker with disability, the Medical Committee sends the dossier to the Employment Administration Guidance and Reclassification Committee. The latter informs you of its decision by registered post within two months.
